Mother Of MS-13 Victim Files Lawsuit Against Biden Administration

The mother of an innocent woman who was murdered and mistreated by the notorious MS-13 Mexican gang recently filed a lawsuit against the Biden administration.

The mother of now-deceased Kayla Hamilton, 20, Tammy Nobles, accused the Biden administration of playing “Russian roulette with our lives” in her lawsuit.

The $100 million lawsuit alleges that the Department of Homeland Security (DHS) and the Department of Health and Human Services (HHS) failed to prevent a member of MS-13 from illegally entering the U.S.

“Nobody at the border did their job and checked his background,” Nobles told NewsNation.

On July 27, 2022, Hamilton was murdered by the MS-13 gang member, who strangled the 20-year-old with a phone cord in her Frederick, Maryland trailer home.

The MS-13 gang member, a 17-year-old Salvadoran national, ran away from a processing facility and made his way to Hamilton’s home.

“He ends up in this trailer home as a roommate with lovely Kayla, that was leased out by another illegal immigrant,” an attorney on behalf of Nobles’ family, Brian Claypool, said.

Nobles’ lawsuit accuses HHS of failing to prevent her daughter’s death by allowing the suspect to flee the holding facility, failing to verify his identity, and failing to confirm a verified sponsor for the Salvadoran national.

Claypool said the department should have prevented the 17-year-old MS-13 gang member since he had a tattoo demonstrating his association with the notorious criminal organization.

Approximately six months after Hamilton’s murder, the suspect was finally arrested after a DNA analysis at the trailer home confirmed his presence.

The 17-year-old Salvadoran national was charged with first-degree murder, among other charges. He is currently being held in jail without bail. His trial will begin on June 28, 2024.

Immigration and Customs Enforcement (ICE) listed the 17-year-old as a member of MS-13.

“We’re bringing this lawsuit because we’re tired of being held hostage in our own country. We’re tired of DHS playing Russian Roulette with our lives,” Claypool said on behalf of the family.

Nobles recently testified before the House amid a GOP-led effort to impeach Homeland Security Secretary Alejandro Mayorkas.

“For me, this is not a political issue, this is a safety issue for everyone living in the United States,” she told the House Homeland Security Committee.
